# Terms of Use

These Terms explain what GetMap does, what you may and may not do with it, how GetMap PRO is billed through Paddle as our Merchant of Record, and where our responsibility ends. Please read them — using the Service means accepting them.

## 1. This agreement

These Terms of Use (the **Terms**) are a contract between you and Juicyapps LLC, registered at [REGISTERED ADDRESS — TBD] (**we**, **us**), the operator of GetMap at [https://getmap.travel](https://getmap.travel/) and of the GetMap mobile apps (together, the **Service**).

By opening an account, subscribing, or otherwise using the Service you accept these Terms. If you do not accept them, do not use the Service.

Two further documents form part of this agreement: the [Privacy Policy](https://getmap.travel/legal/privacy) and the [Refund Policy](https://getmap.travel/legal/refunds). The [Cookie Policy](https://getmap.travel/legal/cookies) explains the storage technologies we use.

## 2. What GetMap does

GetMap is a travel assistant. Depending on the plan, it offers:

- audio guides for places on a map, including synthesised narration;
- a day-by-day trip planner with walking routes between stops;
- weather forecasts and currency conversion for your destination;
- flight and hotel search that links out to partner booking sites;
- photo quests, points, skills, streaks and a leaderboard — a game layer on top of real places.

Automatically generated content

Guide texts, suggested routes and trip plans are produced automatically, in part by language models, from third-party map and place data. They can be incomplete, outdated or simply wrong. Always check opening hours, ticketing, entry requirements, local rules and safety conditions with an official source before you rely on them. GetMap is not a travel agency, a tour operator, or a provider of professional travel, medical, legal or financial advice.

## 3. Who may use the Service

You must be at least 16 years old to hold a GetMap account on your own. If you are between 13 and 16, you may use the Service only with the consent and supervision of a parent or legal guardian, and only where the law of your country allows it. The Service is not directed to, and must not be used by, children under 13.

You also confirm that you are not barred from using the Service under the sanctions or export-control laws that apply to you, and that you will comply with the laws of the country you are travelling in.

## 4. Your account

You can use GetMap as a guest, or sign in with a Google or Apple account. Sign-in is handled by Firebase Authentication, a Google service; a guest session is an anonymous account with an identifier but no name or email attached to it.

- **Keep your account secure.** You are responsible for everything that happens under your account. Tell us promptly if you believe someone else has access to it.
- **Guest sessions are fragile by design.** An anonymous account lives in the browser or app that created it. Clearing site data, switching device or reinstalling can make that account — and the trips, quests and credits on it — unrecoverable. Sign in with Google or Apple to keep your data across devices.
- **One person, one account.** Do not create accounts to farm quest rewards, leaderboard positions or credits.

## 5. Credits, quests and the leaderboard

Credits are an in-app allowance that lets you generate routes and guides. You receive a starting balance, earn more by completing quests, keeping a streak or finishing in-app tasks, and receive a larger allowance on a paid plan.

- Credits, points, skills and leaderboard positions have **no monetary value**. They are not a currency, not property, cannot be exchanged for cash, and cannot be sold or transferred to anyone else.
- We may adjust how many credits an action costs or awards, and we may correct balances obtained through a bug, an exploit or a breach of these Terms.
- Photo quests are verified automatically from the location metadata of the photo you upload. We may reject a submission and, in case of repeated manipulation, close the account.

Quests happen in the real world

You decide where to go and how. Obey local law, respect private property and protected sites, and do not put yourself or anyone else at risk to reach a quest point. We are not responsible for anything that happens while you travel to or from a place shown in the Service.

## 6. GetMap PRO, billing and Paddle

### Our reseller is the merchant

Our order process is conducted by our online reseller [Paddle.com](https://www.paddle.com/). Paddle.com is the **Merchant of Record** for all our orders. Paddle provides all customer service inquiries and handles returns.

In practice: when you subscribe, **the contract of sale is with Paddle, not with us**. Paddle takes the payment, calculates and remits any VAT, GST or sales tax due in your country, issues the invoice or receipt in its own name, and handles billing support, refunds, chargebacks and payment disputes. We supply the Service itself and remain responsible for it under these Terms. Your card details are entered on Paddle's checkout: they are never sent to us and we never store them.

Because Paddle is the seller of record, your purchase is also governed by the [Paddle Checkout Buyer Terms](https://www.paddle.com/legal/buyer-terms), which you accept at checkout, and by the [Paddle Privacy Policy](https://www.paddle.com/legal/privacy). Nothing in those documents removes your rights against us under these Terms.

### Subscription and renewal

This is a recurring subscription

GetMap PRO is a subscription that **renews automatically** and charges your payment method every billing period — every month on a monthly plan, every year on an annual plan — until you cancel. The total price, the billing period and the date of the first renewal are shown on the checkout before you pay, and you have to confirm them to complete the purchase. You can cancel at any time, in a few clicks, without talking to anyone.

- **Price and frequency.** The exact plan, the amount, the billing period and any tax are shown at checkout before you pay, and repeated in the receipt Paddle emails you. Renewals are charged at the same interval, at the then-current price, on or after the day the period renews.
- **Automatic renewal.** Each period renews by itself. There is no confirmation step before a renewal, which is exactly why cancelling is one click and always available.
- **What cancelling does.** It stops the next charge. Your PRO features stay active until the end of the period you have already paid for, and the account then returns to the free plan. Cancelling is not the same as a refund — for that, see the [Refund Policy](https://getmap.travel/legal/refunds).
- **If a payment fails**, Paddle may retry it and may cancel the subscription if it keeps failing; we may suspend PRO features until a payment succeeds.

### How to cancel

Any of these works, and none of them requires our approval:

- in the Service, from your account settings — the same place you subscribed from;
- from the Paddle buyer portal linked in the subscription confirmation email Paddle sent you;
- at [paddle.net](https://paddle.net/), by entering the email address you used for the purchase;
- or by writing to us at [[email protected]](https://getmap.travel/cdn-cgi/l/email-protection) — we will do it for you.

### Price changes

If we change the price of an existing subscription, we will tell you by email at least **30 days** before the new price applies to you. The notice will state the old price, the new price and the date it takes effect. You can cancel before that date and never pay the new price; if you do not cancel, the next renewal is charged at the new price.

Free features remain available on the free plan. We may change what the free and paid plans include, with notice for changes that materially reduce a paid plan.

## 7. Cancellation and refunds

We offer a 14-day money-back guarantee, and consumers in the EU, the UK and other jurisdictions with equivalent rules keep their statutory right of withdrawal. Because Paddle is the Merchant of Record, the refund itself is executed by Paddle, back to the payment method you used, with the tax charged on the order.

## 8. Acceptable use

You agree not to:

- break the law, infringe anyone's rights, or use the Service to harass, endanger or impersonate another person;
- upload content that is unlawful, hateful, sexually explicit, or that shows another identifiable person without their agreement;
- falsify a quest submission, tamper with photo metadata, or otherwise game the credit, points or leaderboard systems;
- scrape, crawl, bulk-download or resell the guides, plans, place data, imagery or audio in the Service, or use them to train a machine-learning model;
- reverse engineer the Service, probe or bypass its security or rate limits, or use our API keys or backend endpoints outside the Service;
- resell, sublicense or make the Service available to third parties as if it were your own.

## 9. Photos and other content you upload

You keep every right you already have in the photos and text you upload (your **Content**). You give us a worldwide, non-exclusive, royalty-free licence to store, reproduce, adapt in format and display your Content **for the purpose of running the Service for you** — for example, showing the photo that completed a quest back to you in your profile.

We do not sell your Content, and we do not publish it outside the Service without asking you first.

You confirm that you own or have permission to upload each item, and that doing so does not break the law where the photo was taken. When you upload a quest photo, the Service reads its embedded location metadata in your browser to check how close the photo was taken to the quest point — see the [Privacy Policy](https://getmap.travel/legal/privacy).

We may remove Content that breaches these Terms or that we are legally required to remove.

## 10. Our content and third-party data

The Service, its software, design, brand and the guide and route content we generate are owned by us or our licensors and are protected by copyright and other laws. Your subscription is a licence to use the Service — it does not transfer ownership of anything.

Some data in the Service comes from third parties and carries their own terms:

- **Google Maps Platform.** Maps, place details, photos and walking routes come from Google. Your use of them is subject to the [Google Maps Platform Terms of Service](https://cloud.google.com/maps-platform/terms) and the [Google Privacy Policy](https://policies.google.com/privacy). You may not copy, cache or redistribute this data outside the Service.
- **OpenStreetMap.** City search suggestions are served through [Photon](https://photon.komoot.io/) from OpenStreetMap data: © [OpenStreetMap contributors](https://www.openstreetmap.org/copyright), available under the [Open Database License (ODbL)](https://opendatacommons.org/licenses/odbl/).
- **Airline, airport and travel-price data** is supplied by Travelpayouts and its partners.

## 11. Affiliate links and partner bookings

Affiliate disclosure

Flight and hotel results in GetMap link to partner booking sites through Travelpayouts. If you book after following one of those links, **we may earn a commission**. It costs you nothing extra, and it does not change the price you are shown.

Prices, availability and conditions belong to the airline, hotel or booking site, not to us. They can change between the moment we show them and the moment you book. Any booking you make is a contract between you and that provider; we are not a party to it and cannot change, cancel or refund it. Take up problems with a booking directly with the provider.

## 12. Third-party services

The Service depends on providers we do not control:

- **Paddle** — the checkout, payments, tax, invoices and refunds, as Merchant of Record.
- **Google** — Firebase Authentication for sign-in, and Google Maps Platform for maps, places and walking routes. **Apple** — Sign in with Apple, if you choose it.
- **Supabase** — the database and file storage that hold your profile, progress and quest photos.
- **Vercel** — hosting and content delivery for the website.
- **Travelpayouts** — airport, airline and travel-price data, and the partner booking links.

Their own terms apply to their part of the experience. We are not responsible for their availability, accuracy or practices.

## 13. Availability and disclaimers

We work to keep GetMap running, but we do not promise uninterrupted or error-free operation. Features can change, and parts of the Service may be unavailable during maintenance, during an outage at one of our providers, or in some countries.

To the maximum extent permitted by law, the Service is provided **as is and as available**, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement and the accuracy, completeness or timeliness of any content, price, forecast, exchange rate, route or place information it displays.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or the statutory rights of consumers.

## 14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost bookings, missed flights, lost data, or costs of substitute services, arising out of or in connection with the Service.

Our total liability for all claims relating to the Service in any twelve-month period is limited to the greater of (a) the amount you actually paid us for the Service in that period, and (b) fifty euros (EUR 50).

If you are a consumer, these limits apply only as far as the law of your country of residence permits; your mandatory statutory rights are unaffected.

## 15. Indemnity

If you use the Service in breach of these Terms or of the law, you agree to indemnify us against claims, damages and reasonable costs (including legal fees) that arise from that use, including claims by third parties about content you uploaded. This does not apply to the extent the claim is caused by our own breach or negligence, and it does not apply to consumers where local law does not allow it.

## 16. Suspension and termination

You can stop using the Service at any time, cancel a subscription from the customer portal, and ask us to delete your account (see the [Privacy Policy](https://getmap.travel/legal/privacy)).

We may suspend or close an account that breaches these Terms, that we are legally required to close, or that is being used to attack or defraud the Service or its users. Where it is reasonable and lawful, we will warn you first and give you a chance to fix the problem. Closing an account ends the licence to use the Service and removes any remaining credits; if we close a paid account without cause, we will refund the unused part of the current billing period.

## 17. Changes to the Service and to these Terms

We may update these Terms — for example when we add a feature, change a provider, or a law changes. The effective date at the top of this page always shows the current version.

For changes that materially affect your rights or a paid plan, we will give reasonable advance notice in the app or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not accept them, stop using the Service and cancel your subscription.

## 18. Governing law and disputes

These Terms and any dispute arising from them are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.

If you are a consumer resident in the EEA or the UK, this choice of law does not deprive you of the protection of the mandatory rules of your own country, and you may bring proceedings in the courts of your place of residence.

Before starting formal proceedings, please write to us — most problems are faster to solve by email.

## 19. General

- If a clause of these Terms is found invalid, the rest stays in force and the invalid clause is read as narrowly as needed to make it valid.
- Not enforcing a right immediately does not mean we give it up.
- You may not transfer your rights under these Terms. We may transfer ours to a company that takes over the Service, provided your rights are not reduced.
- These Terms, together with the Privacy Policy and the Refund Policy, are the whole agreement between us about the Service.
- These Terms are written in English. A translation is provided for convenience only; the English version prevails.
